1. Seller Identification

These Terms and Conditions of Sale (hereinafter referred to as the “TCS”) govern the sale of services provided by PLEYADS, operated by:

2. Purpose

PLEYADS offers a community platform dedicated to collaborative algorithmic trading, allowing its members to:
• Discover and collectively test trading bots,
• Interact within the community,
• Access exclusive tools, analyses, results, and information.

These TCS define the terms of access to these services, the subscription, payment, and termination procedures, and the mutual obligations between PLEYADS and its members.

3. Membership Plans and Subscriptions

PLEYADS offers three membership plans whose prices and features may evolve over time:

a) Lifetime Offer
• Exceptional offer available only during limited periods.
• Permanent access to the community and to all content related to algorithm testing and results.
• Specific guarantee described in Article 8.

b) Monthly Subscription
• Standard subscription starting at $9/month.
• The rate may change at any time for new subscribers.
• Members keep the rate applicable at the time of their subscription as long as they remain continuously subscribed.

c) Annual Subscription
• One-time payment covering a 12-month period.
• Preferential rate compared to the monthly plan.

4. Orders and Payment

Payments are secured and processed via Stripe.
Access to services is automatically activated once payment is confirmed.
The client agrees to provide accurate information when placing an order.
PLEYADS reserves the right to suspend any account in the event of a refused or disputed payment.

5. Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content delivered immediately after purchase, nor to services fully performed before the withdrawal period expires.

By confirming their order, the client expressly waives their right of withdrawal in order to gain immediate access to the PLEYADS community and its content.

(If Skool requires the inclusion of a withdrawal right, a 14-day period is granted, but immediate access constitutes express waiver.)

6. Hosting and Data Management on Skool

PLEYADS services, as well as all content, messages, files, statistics, and member data, are hosted and managed via the Skool platform.

Accordingly:
• PLEYADS has no direct control over Skool’s servers, availability, or technical security.
• PLEYADS cannot be held responsible for any malfunction, slowdown, temporary outage, data loss, content deletion, or access issues related to Skool or its third-party services.
• Members acknowledge that they use the PLEYADS community via Skool at their own risk and in accordance with Skool’s Terms of Use.

Any outage or malfunction related to Skool shall not entitle the member to any compensation, refund, or subscription extension from PLEYADS.

7a. Affiliate Program Managed by Skool

The affiliate program is fully managed by the Skool platform.
All tracking, statistics, sale attributions, commission calculations, and payments are handled by Skool’s internal system.

Accordingly:
• Only the data and records provided by Skool shall be deemed valid.
• PLEYADS does not intervene in the calculation of commissions, validation of affiliate sales, or distribution of payments.
• PLEYADS cannot be held responsible for any malfunction, delay, misattribution, data loss, or technical issue related to the Skool platform.

Any claim concerning the technical operation or accounting of affiliate sales must be submitted directly to Skool, in accordance with their own Terms of Use.

7b. Affiliate Program

From the official launch date, PLEYADS offers an affiliate program reserved for its members:
• Commission: 40% on sales generated through personal referral links.
• Applicability: valid on all available offers (Lifetime, Monthly, Annual).
• Technical setup: subject to Skool’s built-in capabilities and limitations.
• Commissions are calculated and paid according to the conditions defined on the platform.

Any fraudulent activity, spam, or traffic manipulation will result in immediate account termination without notice or refund.

8. Code of Conduct and Exclusion

PLEYADS is a collaborative community.
Each member agrees to behave respectfully toward other participants and the administration team.

The following are strictly prohibited:
• Offensive, defamatory, racist, or discriminatory remarks,
• Unauthorized advertising, solicitation, spam, or sharing of paid trading signals,
• Distribution of illegal content or material harmful to PLEYADS’ reputation,
• Unauthorized attempts to access data, systems, or bots under test.

Failure to comply with these rules may result in suspension or permanent termination of the member’s account without full or partial refund of any amounts paid.

9a. Access to the Lifetime Offer

This exceptional offer grants the member lifetime access to PLEYADS services and community, in exchange for a one-time payment.
Access remains valid as long as the member complies with these Terms and the community’s code of conduct.
Any violation of these rules may result in suspension or permanent termination of access, without refund, as stated in Article 7.

9b. Founder Lifetime Offer with Refund Guarantee

If, during the first year following registration, no bot tested by the community achieves an average monthly performance exceeding 3% profit, the member may request a full refund of their Lifetime offer during the 11th month, before the anniversary date of their account.
After that date, no refund can be claimed.

Refund conditions:
• The request must be sent by email via the official support channel,
• The member must not have earned any affiliate commissions during their membership,
• Access to the community will be closed on the refund date, and the account canceled,
• The member will lose all connections, credits, and benefits associated with PLEYADS and its affiliate program,
• The refund will be processed within 30 days maximum.

10. Liability

PLEYADS does not provide investment, management, or financial advisory services.
All information, tools, and bots are provided for experimental and educational purposes only.
Each member remains solely responsible for their trading decisions.

PLEYADS cannot be held liable for:
• Financial losses resulting from the use of any bot or strategy,
• Service interruptions, bugs, or temporary outages,
• Improper use of its tools or community features.

11. Termination

The client may cancel their subscription at any time through the platform.
Any billing period already started remains due, and no partial refund shall be granted.
PLEYADS reserves the right to terminate any account in case of breach of these TCS.

12. Personal Data

Data collected are used solely for the management of subscriptions, community access, and internal communication.
No data is sold to third parties.
In accordance with the GDPR, members may request the deletion or modification of their information at any time by contacting the email address provided in Clause 1.

13. Intellectual Property

All content, visuals, videos, logos, and documents distributed on PLEYADS remain the exclusive property of Lowqanta.
Any unauthorized reproduction, distribution, or resale is strictly prohibited.

14. Governing Law and Jurisdiction

These TCS are governed by French law.
Any dispute shall fall under the jurisdiction of the competent courts within the jurisdiction of Lowqanta’s registered office.

15. Acceptance

By validating their registration and payment, the client acknowledges having read and unreservedly accepted these Terms and Conditions of Sale.

16. Gamification System and Community Recognition

PLEYADS implements an internal progression system allowing members to earn:
• Experience levels (e.g., Explorer, Analyst, Validator, Founder, etc.),
• Contribution badges or stars (silver/gold),
• Other forms of recognition visible within the community.

These elements are purely symbolic, designed to value participation, collaboration, and contribution to bot development and the project’s growth.
They confer no contractual rights, financial advantage, or performance guarantee.
PLEYADS reserves the right to modify, suspend, or remove this system at any time without notice.

17. Modification of the TCS

PLEYADS reserves the right to modify these Terms and Conditions of Sale at any time, particularly to reflect service changes, legal developments, or updates to the Skool platform.
Modifications take effect upon publication on the site or platform.
Existing members will be notified by email or internal message, and continued use of the service constitutes acceptance of the new terms.

18. Pricing, Currency, and Billing

All prices displayed on PLEYADS are in US dollars (USD), excluding any potential banking, conversion, or exchange fees applied by the client’s payment provider or bank.
All transactions are processed via Stripe, ensuring secure payments.
No alternative payment methods are accepted without prior written consent from PLEYADS.

19. Member Contributions and Intellectual Property

Members may propose, share, or submit ideas, algorithms, indicators, or trading strategies within the community.
By submitting a contribution, the member grants PLEYADS a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute it as part of the platform and its services.
Contributions remain the property of their authors, but no remuneration or royalties may be claimed for collective or internal use.
PLEYADS may freely select, test, or remove any submitted content without obligation to provide justification.

20. Force Majeure

PLEYADS shall not be held responsible for delays, failures, or inability to perform resulting from force majeure, as defined under French law — including but not limited to natural disasters, war, cyberattacks, server failures, network outages, or any other unforeseeable events beyond its control.

21. Support and Communication

All official communication with the PLEYADS team must be conducted through the channels indicated on the website or the Skool platform.
PLEYADS cannot be held responsible for information transmitted via unverified accounts, private messages, or unofficial platforms (Telegram, Discord, etc.) unless expressly stated otherwise.
